Name
Change
In order to
legally change your name in Florida,
a Petition with the Circuit Court
must be filed. Any lawful reason
that the Petitioner deems a benefit
is typically adequate to satisfy
most Courts. For example, the
Petitioner may prefer a new name due
to social or
religious
reasons, for
convenience, to honor an ancestral
name or just personal preference.
A Petitioner may not change his or
her name for purposes of fraud or if
it will violate the rights of
others. A hearing before a circuit
court judge may be required. The
judge has discretion, and may deny
the name change if the Petitioner
fails to prove legal residency in
the state, has illegal or ulterior
motives behind the change, or if the
new name interferes with someone
else's rights.
A Wife can
have her former name restored to her
in a divorce action if she
requests it.
